Terms of Engagement

These Terms of Engagement govern the supervision relationship between Dr Soheil Afshar ("Supervisor") and the supervisee ("you"). By entering into a supervision agreement with me, you agree to be bound by these terms. A formal supervision agreement will be completed and signed by both parties before supervision commences.
These terms are intended to complement — not replace — the formal supervision agreement we will complete together. If any conflict arises between these terms and the signed supervision agreement, the supervision agreement will take precedence.
1. Nature of the Supervision Relationship
Supervision provided by Dr Soheil Afshar is professional clinical supervision delivered in accordance with the standards of the Psychology Board of Australia (PsyBA) and relevant ethical guidelines of the psychological profession in Australia.
Supervision is not therapy, counselling, or personal coaching. The supervisory relationship is a professional one focused on your development as a practitioner and the welfare of your clients.
2. Supervisor Responsibilities
As your supervisor, I commit to:
- Providing supervision in accordance with PsyBA standards and the relevant supervision guidelines for your registration pathway
- Maintaining confidentiality of information disclosed during supervision, subject to mandatory reporting obligations and safety considerations
- Providing honest, constructive, and timely feedback on your clinical work
- Maintaining accurate records of supervision sessions
- Notifying you promptly if I am unable to continue as your supervisor for any reason
- Completing all required documentation for your registration pathway in a timely manner
3. Supervisee Responsibilities
As a supervisee, you are responsible for:
- Attending scheduled supervision sessions punctually and prepared
- Providing accurate and honest accounts of your clinical work
- Disclosing any concerns about your practice, wellbeing, or fitness to practise that may be relevant to supervision
- Maintaining your own registration and meeting all requirements of your registration pathway independently
- Notifying me promptly if you are unable to attend a scheduled session
- Engaging with feedback in a reflective and open manner
- Practising within your scope of competence at all times
4. Delivery of Supervision
All supervision is delivered via telehealth using a secure video conferencing platform. You are responsible for ensuring you have a reliable internet connection and a private, confidential space for sessions. Sessions should not be conducted from a location where client information could be overheard by others.
Session frequency and duration will be agreed upon at the commencement of the supervision relationship and reviewed regularly. Changes to scheduling will be agreed upon with reasonable notice from either party.
5. Fees and Payment
Supervision fees are agreed upon prior to the commencement of the supervision relationship and set out in the formal supervision agreement. Fees are reviewed periodically and any changes will be communicated with a minimum of four weeks' notice.
Invoices are issued following each supervision session or as otherwise agreed. Payment is due within 14 days of the invoice date unless alternative arrangements have been made in writing.
Sessions cancelled with less than 48 hours' notice may incur a cancellation fee of up to 50% of the session fee, at my discretion. Sessions cancelled with less than 24 hours' notice or not attended without notice may be charged in full.
6. Confidentiality
Information disclosed during supervision is treated with professional confidentiality. However, confidentiality has limits. I am required to breach confidentiality in the following circumstances:
- Where there is a mandatory notification obligation under the Health Practitioner Regulation National Law, including where I form a reasonable belief that you have behaved in a way that constitutes notifiable conduct
- Where there is a serious and imminent risk to the life or safety of you or another person
- Where disclosure is required by law or a court order
I will discuss any mandatory notification obligations with you where it is safe and appropriate to do so before making a report.
7. Record Keeping
I maintain records of supervision sessions including dates, duration, topics discussed, and progress notes. These records are stored securely and retained for a minimum of 7 years following the conclusion of our supervision relationship, in accordance with professional and legal obligations.
You are encouraged to maintain your own contemporaneous supervision records as required by your registration pathway.
8. Mandatory Notifications
As a registered psychologist, I have mandatory notification obligations under the Health Practitioner Regulation National Law. If during the course of supervision I form a reasonable belief that you have engaged in notifiable conduct, I am required to report this to AHPRA. Notifiable conduct includes practising while intoxicated, engaging in sexual misconduct with a client, placing the public at risk through an impairment, or placing the public at risk through a significant departure from accepted professional standards.
9. Termination of the Supervision Relationship
Either party may terminate the supervision relationship with a minimum of four weeks' written notice. In circumstances where continuation of the supervision relationship is not appropriate — for example, due to a conflict of interest, a mandatory notification, or a breakdown of the professional relationship — the notice period may be shortened by mutual agreement.
Where I initiate termination, I will endeavour to assist you in identifying an alternative supervisor and will provide any documentation required for your registration pathway up to the date of termination.
10. Limitation of Liability
Supervision is provided to support your professional development. Responsibility for clinical decisions made in your practice remains with you at all times. I am not liable for outcomes arising from clinical decisions you make independently of, or contrary to, guidance provided in supervision.
11. Governing Law
These Terms of Engagement are governed by the laws of New South Wales, Australia. Any disputes arising from the supervision relationship will be subject to the jurisdiction of the courts of New South Wales.
